COUNCIL MEETING MINUTES

 

AUGUST 20, 2007

 

 

 

I. CALL TO ORDER & PLEDGE OF ALLEGIANCE

Mayor Rod Davies called the meeting to order in the Council Chambers at City Hall, 100 East Broadway, Monmouth, Illinois at 7:01 p.m. and led the audience in the Pledge of allegiance to the Flag.

 

II. ROLL CALL

 

Present: Aldermen Dan Burgland, Dave Rutledge, Dave Giles, Dave Smith, Bob Wells, Dan Heatherly, Rod Themanson, and Alderwoman Vicki McNamara Also Present: Mayor Rod Davies, City Clerk Susan S. Trevor, City Attorney Marcum Spears, Fire Chief Jim Conard, Police Chief Brad Zeigler, EMC Public Works Director Andy Jackson, Cemetery/Zoning Administrator Chuck Talley, and members of the Press.

 

III. APPROVAL OF MINUTES

 

1. Approval of August 6, 2007 Minutes

 

It was moved by Alderman Themanson and seconded by Alderman Rutledge to approve the minutes of the August 6 th meeting as presented. AYE: Aldermen Burgland, Rutledge, Wells, Heatherly, Themanson, and Alderwoman McNamara PASS: Aldermen Giles and Smith NAY: none MOTION CARRIED.

V. COMMITTEE REPORTS

 

A. Public Works – Chairman Dave Smith

 

Chairman Smith asked EMC Public Works Director, Andy Jackson for an update on the scales for the transfer station. Mr. Jackson reported that Wahl Scales had been out to look at the scales and would be sending a cost estimate pertaining to the installation costs. Chairman Smith also asked about future plans for televising sewers. Mr. Jackson answered that he felt that it would be advisable to televise the 1000 block of East Broadway going south to determine if a manhole would be needed in that area. He had checked with Roto-Rooter and the price per foot would be the same as the earlier downtown televising. In addition to televising that section, Mr. Jackson also thought that it would be wise to continue on north to the main interceptor from where the initial televising of the 100- year- old sewer had stopped at East Broadway and 4 th Street. Alderman Rutledge asked Mr. Jackson to explain the letter from the IEPA concerning the City's Combined Sewer Overflow and Maintenance Plan. Mr. Jackson said that the City had been aware that it needed an updated CSO & M Plan, but had stated to the IEPA that the City felt that it would make more sense to wait until our new Wastewater Treatment Plant is completed. Mr. Garretson from the IEPA understood, but said that the Federal EPA is leaning on the state agencies to get everyone's plans in. Andy said that the best course of action probably would be to request a meeting with Mr. Kammueller in Peoria to present our situation and determine if an extension could be granted.

 

B. Public Safety – Chairman Dan Burgland

 

1. Monmouth College Requests for Parking on North 9 th and Grace Bible Church request to hold a block party

 

It was moved by Alderman Themanson and seconded by Alderman Rutledge to approve the requests from Monmouth College to allow parking on the West side of North 9 th Street for the football home games on September 1, 15, 29, and October 6 and 27 as well as on October 3 rd for a Graduate and Professional School Fair; and to also permit Grace Bible Church to host a Praise Fest/Block Party on September 23, 2007 from 2:00 p.m. to 5:00 p.m. AYE: Aldermen Rutledge, Giles, Smith, Wells, Heatherly, Themanson, Burgland, and Alderwoman McNamara NAY: none MOTION CARRIED.

 

C. Community Development – Chairman Dave Giles

 

Chairman Giles announced that there would be a Citizen's Lake Advisory Committee meeting on Friday, August 24 th at 4:00 p.m. in the Campground at Citizen's Lake.

 

D. Finance/Audit – Chairman Dan Heatherly

 

1. Approval of Bills

 

It was moved by Alderman Giles and seconded by Alderman Themanson to approve the bills as presented. AYE: Aldermen Giles, Smith, Wells, Heatherly, Themanson, Burgland, Rutledge, and Alderwoman McNamara NAY: none MOTION CARRIED.

 

VI. ORDINANCES

 

A. 1 st Reading

 

07-021 – Granting Variance – 421 N. E Street, Robert Stinemates

07-022 – Granting Variance – 301 Industrial Park Rd., Bridgeway

3. 07-023 – Granting Variance & Special Use – 1017 South D Street, Carmen Flores

4. 07-024 – Granting Variance – 925 E. Broadway, Barry McClintock

Mr. Caleb Britton, South D Street, asked to address the Council as to the Granting a Variance at 1017 South D Street. He explained that he lived next door and the water run-off comes into his property anyway as his is the low lot and if a trailer is permitted on that lot it will make matters worse. He also objected to the fact that the existing alleyway would be used as a driveway to the proposed trailer and as it sits higher, he was concerned where the snow would go in the winter when it had to be cleared. Mayor Davies asked Mr. Britton if he was present to voice his objections at the Zoning Board of Appeals and he stated that he had been. It was moved by Alderman Heatherly and seconded by Alderman Smith to uphold the recommendation for approval by the Zoning Board of Appeals of the above-stated ordinances. AYE: Aldermen Smith, Wells, Heatherly, Burgland, Rutledge, Giles, and Alderwoman McNamara NAY: Alderman Themanson MOTION CARRIED.

 

5. 07-025 – amending Section 51.55 "Application for Water Service; Fees"

 

City Attorney Spears explained that this amendment was just clarifying language in this section with reference to deposits and changing the verbiage to read "service fees" instead of "turn-on fees". It was moved by Alderman Themanson and seconded by Alderwoman McNamara to approve the above-stated ordinance. AYE: Aldermen Wells, Heatherly, Themanson, Burgland, Rutledge, Giles, Smith, and Alderwoman McNamara NAY: none MOTION CARRIEFD.

 

 

 

6. 07-026 – adding Section 78 & Chapter 78, "Impoundment of Vehicles"

 

Chief Zeigler reviewed the offenses for which the vehicles of arrested suspects could be impounded as follows: 1) Possession of Cannabis 2) DUI 3) Driving while drivers license is suspended or revoked 4) Fleeing and attempting to elude a police officer 5) Possession of Drug paraphernalia 6) Possession of a controlled substance. Chief Zeigler also added that in 2006 there were 186 vehicles involved in arrests in the City of Monmouth that would have fallen into theses categories. According to Chief Zeigler, around 80% of the impounded car retrieval fee of $500 is the average amount that is collected. It was moved by Alderman Wells and seconded by Alderwoman McNamara to approve the above-stated ordinance. AYE: Alderwoman McNamara, Aldermen Themanson, Burgland, Rutledge, Giles, and Wells NAY: Aldermen Heatherly and Smith MOTION CARRIED.

 

VII. OTHER BUSINESS

VIII. EXECUTIVE SESSION

It was moved by Alderwoman McNamara and seconded by Alderman Heatherly to go into Executive Session to:

 

Discuss Personnel

Lease of Real Estate with Possible Action in Regular Session

AYE: Aldermen Heatherly, Themanson, Burgland, Rutledge, Giles, Smith, Wells, and Alderwoman McNamara NAY: none MOTION CARRIED.

 

IX. RETURN TO REGULAR SESSION

 

It was moved by Alderman Themanson and seconded by Alderman Giles to return to Regular Session at 7:54 p.m. AYE: Aldermen Themanson, Burgland, Rutledge, Giles, Smith, Wells, Heatherly, and Alderwoman McNamara NAY: none MOTION CARRIED.

 

It was moved by Alderman Heatherly and seconded by Alderman Wells to approve a possible lease with W.S., Inc. AYE: Aldermen Burgland, Rutledge, Giles, Smith, Wells, Heatherly, Themanson, and Alderwoman McNamara NAY: none MOTION CARRIED.

 

X. ADJOURNMENT

 

It was moved by Alderman Smith and seconded by Alderman Themanson to adjourn the meeting at 7:55 p.m. MOTION CARRIED by unanimous voice vote.
