COUNCIL MEETING MINUTES

I. CALL TO ORDER & PLEDGE OF ALLEGIANCE
Mayor Rod Davies called the meeting to order and led the audience in the Pledge of Allegiance to the Flag.
II. ROLL CALL
City Clerk Susan S. Trevor called the roll and those answering present were: Aldermen Tim Heatherly, Dave Rutledge, Bob Wells, Dan Heatherly, Jaime Godina, and Alderwoman Vicki McNamara. Also Present: Mayor Rod Davies, City Clerk Susan S. Trevor, City Administrator Eric Hanson, City Attorney Marcum Spears, Fire Chief Jim Conard, Police Chief Brad Zeigler, EMC Public Works Director Andy Jackson, Cemetery/Zoning Administrator Chuck Talley, and members of the Press. Absent: Alderman Dave Bates
III. APPROVAL OF MINUTES – September 8, 2009
It was moved by Alderwoman Vicki McNamara and seconded by Alderman Rutledge to approve the minutes of the September 8, 2009 meeting as presented. AYE: Aldermen T. Heatherly, Rutledge, Wells, D. Heatherly, Godina, and Alderwoman McNamara NAY: none ABSENT: Alderman Bates
IV. PROCLAMATIONS
Mayor Davis read a proclamation declaring September 28, 2009 as "Family Day -- A Day to Eat Dinner With Your Children."

1. Employee Recognition
Mayor Davies presented certificates of appreciation and "Monmouth Bucks" to City employees for the following years of service:

2. Approval of Consent Agenda
It was moved by Alderman D. Heatherly and seconded by Alderman Rutledge to approve the Consent Agenda – M.C. Homecoming Parade Requests, Bills, and Committee of the Whole Minutes from 09/08/09 as presented. AYE: Aldermen Rutledge, Wells, D. Heatherly, Godina, T. Heatherly, and Alderwoman McNamara NAY: none ABSENT: Alderman Bates
C. Committee of the Whole Discussion Items
1. Engineering Services Agreement/Donohue & Assoc. for North WWTP Phosphorous Removal
It was moved by Alderman D. Heatherly and seconded by Alderman Wells to approve the Engineering Service Agreement with Donohue & Associates for the 30% Design Phase of the Phosphorus Removal for the North WWTP. AYE: Aldermen Wells, D. Heatherly, Godina, T. Heatherly, Rutledge, and Alderwoman McNamara NAY: none ABSENT: Alderman Bates MOTION CARRIED.
VI. PASSAGE OF ORDINANCES AND RESOLUTIONS
A. Ordinances – 1st Reading
1. 09-024 – Amending Schedule V. Chapter 77, Disabled Parking, 628 N. 2nd Street
It was moved by Alderman Wells and seconded by Alderman Rutledge to approve Ordinance 09-024, which removes the disabled parking space located at 628 N. 2nd Street. AYE: Aldermen Wells, D. Heatherly, Godina, T. Heatherly, Rutledge, and Alderwoman McNamara NAY: none ABSENT: Alderman Bates MOTION CARRIED.
2. 09-025 – Amending Section 99.001, Chapter 99, entitled Boulevards
City Attorney Spears found that the current ordinance regulating parking did not have a clear definition regarding parking on a boulevard and this amendment will simply clarify the language. If a car is parked on a boulevard, it can be ticketed for parking and for any damage done to curbing or land area. Administrator Hanson emphasized that this provision will sometimes allow parking, but it will have to be done according to the City's specifications. Chief Zeigler stated that enforcement will be done through complaints and observation by officers.
It was moved by Alderman Wells and seconded by Alderman T. Heatherly to approve Ordinance 09-025 amending Section 99.001, Chapter 99, entitled Boulevards. AYE: Aldermen Wells, D. Heatherly, Godina, T. Heatherly, Rutledge, and Alderwoman McNamara NAY: none ABSENT: Alderman Bates MOTION CARRIED.
VII. BIDS, PETITIONS, AND COMMUNICATIONS
A. Bid Results for 512 & 514 South 3rd
Chuck Talley, Cemetery/Zoning Administrator, reported that Brown Excavating from Alpha, Illinois, submitted the low bid of $13,435.00 for the demolition and asbestos removal for the structure located at 512 and 514 South 3rd Street. It was moved by Alderman D. Heatherly and seconded by Alderman T. Heatherly to approve the bid of $13,435 by Brown Excavating for the demolition of 512 and 514 South 3rd Street. AYE: Alderwoman McNamara, Aldermen D. Heatherly, Godina, T. Heatherly, Rutledge, and Wells NAY: none ABSENT: Alderman Bates MOTION CARRIED.
VIII. CITY ADMINISTRATORS REPORT
Administrator Hanson reported that the ARRA work has begun on North Main with the curb replacement, which should take around two weeks. The street will then be milled down and new asphalt applied. The total project should take around 30 days. Administrator Hanson also said that the City would be responsible for removing the tracks near the intersection of North Main and the By-Pass. IX. ADJOURNMENT
It was moved by Alderwoman McNamara and seconded by Alderman D. Heatherly to adjourn the meeting at 7:40 p.m. MOTION CARRIED by unanimous voice vote with the exception of Alderman Bates, who was absent.
