COUNCIL MEETING MINUTES

I. CALL TO ORDER & PLEDGE OF ALLEGIANCE
Mayor Rod Davies called the meeting to order and led the audience in the Pledge of Allegiance to the Flag.
II. ROLL CALL
City Clerk Susan Trevor called the roll and those answering present were: Aldermen Tim Heatherly, Dave Rutledge, Dave Bates, Bob Wells, Dan Heatherly, Jaime Godina, and Alderwoman Vicki McNamara. Also Present: Mayor Rod Davies, City Clerk Susan S. Trevor, City Administrator Eric Hanson, City Attorney Marcum Spears, Fire Chief Jim Conard, Police Chief Brad Zeigler, EMC Public Works Director Andy Jackson, Cemetery/Zoning Administrator Chuck Talley, and members of the Press. Vacant: 2nd Ward Alderman seat vacant due to death of Alderman Dave Smith
III. APPROVAL OF MINUTES
It was moved by Alderman T. Heatherly and seconded by Alderwoman McNamara to approve the minutes of the August 17th meeting as presented. AYE: Aldermen T. Heatherly, Rutledge, Bates, D. Heatherly, Godina, and Alderwoman McNamara NAY: none PASS: Alderman Wells MOTION CARRIED.
IV. PROCLAMATIONS
Mayor Rod Davies read a proclamation declaring September 15, 2009 through October 15, 2009 National Hispanic Heritage month. There will be a celebration on September 15th from 5:00 – 8:00 p.m. at the 1st Street Armoury to kick-off National Hispanic Heritage month. Alderman Godina complimented Theresa Cabarra, our local VISTA worker on all the work that she has put into organizing the kick-off event.
V. PRESENTATION TO THE COUNCIL
A. Old Business
There was none to consider.
B. New Business
Mayor Davies welcomed Alderman Bob Wells back after his lengthy recuperation from his accident.
1. Approval of Consent Agenda
a. Grace Bible Church Praise Fest Street Closure – 9/26/09
b. Street Closure S. Main St./Pattee Lot – 10/3/09 – Monmouth Women's Assoc.
c. Halloween Trick or Treat Hours – 10/31/09 – 5:30p.m. to 8:00 p.m.
It was moved by Alderman Wells and seconded by Alderman Rutledge to approve all items listed on the Consent Agenda. MOTION CARRIED by unanimous voice vote.
C. Committee of the Whole Discussion Items
1. Homeowner Request for Removal of Handicapped Parking Space – 628 N. 2nd Street
Administrator Hanson said that notices will be sent to neighbors and he will work with City Attorney Spears to draft an ordinance to present at the next Council meeting.
2. Closure of West Archer next to ICS
Council asked staff to look into the situation and report back at the next Council meeting.
3. Approval of Bills
It was moved by Alderman Heatherly and seconded by Alderwoman McNamara to approve the bills as presented. AYE: Aldermen Bates, Wells, D. Heatherly, Godina, T. Heatherly, Rutledge, and Alderwoman McNamara NAY: none MOTION CARRIED.
2. Approval of August 17, 2009 Finance Committee Minutes
It was moved by Alderman D. Heatherly and seconded by Alderman Bates to approve the minutes of the August 17th meeting as presented. AYE: Alderwoman McNamara, Aldermen D. Heatherly, T. Heatherly, and Bates. NAY: none MOTION CARRIED.
VI. PASSAGE OF ORDINANCE AND RESOLUTIONS
A. 1ST Reading
1. Ordinance 09-021 – Amending Chapter 31, "City Officials", Chapter 38, City Policies, and Chapter 53, "solid Municipal Waste"
2. Ordinance 09-022 – Amending Schedule I of Chapter 77, "Prohibited Parking"
It was moved by Alderman D. Heatherly and seconded by T. Heatherly to approve Ordinances 09-021 and 09-022 collectively as stated. AYE: Alderwoman McNamara, Aldermen D. Heatherly, Godina, T. Heatherly, Rutledge, Bates, and Wells NAY: none MOTION CARRIED.
3. Ordinance 09-023 – Granting Request for Shelter House & Restroom –
1244 E. Broadway
It was moved by Alderman D. Heatherly and seconded by Alderman T. Heatherly to approve ordinance 09-023 as stated. AYE: Aldermen D. Heatherly, Godina, T. Heatherly, Rutledge, Bates, Wells, and Alderwoman McNamara NAY: none MOTION CARRIED.
VII. BIDS, PETITIONS AND COMMUNICATIONS
Zoning Administrator Chuck Talley reported that the notice for bids for the demolition of 512-514 South 3rd Street was in the paper on Saturday. He also said that the Junk and Debris notices sent out in August were 30 more than those sent in July.
VIII. CITY ADMINISTRATOR'S REPORT
Administrator Hanson asked if there were any questions concerning his update and hearing none stated that he had nothing additional to report at this time.
IX. ADJOURNMENT
It was moved by Alderman D. Heatherly and seconded by Alderman T. Heatherly to adjourn the meeting at 7:35 p.m. MOTION CARRIED by unanimous voice vote.
