COUNCIL MEETING MINUTES

I. CALL TO ORDER & PLEDGE OF ALLEGIANCE
Mayor Rod Davies called the meeting to order in the Council Chambers at City Hall at 7:00 p.m. and led the audience in the Pledge of Allegiance to the Flag.
II. ROLL CALL
City Clerk Susan Trevor called the roll and those answering Present were: Aldermen Tim Heatherly, Dave Rutledge, Dave Bates, Les Dollinger, Bob Wells, Dan Heatherly, Jaime Godina and Alderwoman Vicki McNamara Also Present: Mayor Rod Davies, City Clerk Susan S. Trevor, City Administrator Eric Hanson, City Attorney Marcum Spears, Fire Chief Jim Conard, Police Chief Brad Zeigler, EMC Public Works Director Andy Jackson, and members of the Press. Absent: Cemetery/Zoning Administrator Chuck Talley
III. APPROVAL OF MINUTES
A. April 19, 2010 Minutes
It was moved by Alderman Tim Heatherly and seconded by Alderman Les Dollinger to approve the minutes of the April 19th meeting as presented. AYE: Aldermen Tim Heatherly, Rutledge, Bates, Dollinger, Wells, Dan Heatherly, Godina and Alderwoman McNamara NAY: none MOTION CARRIED.
IV. PRESENTATION TO THE COUNCIL
Mayor Davies removed the scheduled Executive Session from the Agenda.

B. New Business
1. Consent Agenda
a. Approval of Bills
It was moved by Alderman Dan Heatherly and seconded by Alderwoman Vicki McNamara to approve the bills as presented. AYE: Aldermen Bates, Dollinger, Wells, Dan Heatherly, Godina, Tim Heatherly, Rutledge and Alderwoman McNamara NAY: none MOTION CARRIED.
C. Committee of the Whole discussion Items
1. EMC Monthly Report – Andy Jackson
During the month of March, according to Mr. Jackson, there were a lot of street repairs along with completion of the snow removal. The start-up of the new WWTP kept the department busy as well. In the new few days Denton-Gunther Underground will begin the repair under the railroad tracks on South D Street. The work should be completed in two or three days. Mr. Jackson also reported that during the recent storm the new WWTP experienced a major power outage and both new generators ran just as they were supposed to do with just some small glitches, which will be addressed as soon as possible.
2. WWTP Update – Joe Pisula
Donohue and Associates engineer, Joe Pisula, reported that a Pay Estimate meeting was held today with a payout amount of roughly $770,000, which includes the reduction of the retainage fee to about $300,000. He also reported that the City has not heard back from the IEPA as to whether there will be issues due to the late substantial completion date and the new challenge will be to have the total completion done by July 30th.
3. Engineering Agreement for South Main Street Water Main Project
Administrator Hanson explained that the City applied for a grant to help pay for the water main replacement on South Main Street and we have received the money. We now need to approve the Engineering Service Agreement with Missman, Stanley & Associates for the approximate amount of $27,500. It was moved by Alderman Wells and seconded by Alderman Godina to approve the Engineering Service Agreement with Missman, Stanley & Associates for the water main replacement on South Main Street. AYE: Aldermen Bates, Dollinger, Wells, Dan Heatherly, Godina, Tim Heatherly, Rutledge, and Alderwoman McNamara NAY: none MOTION CARRIED.
4. Bijou Pub Outdoor Special Events Application
The Bijou Pub in conjunction with the Martial Arts Event taking place at the 1st Street Armoury on May 15, 2010 from 2:00 p.m. to 11:00 p.m., is requesting permission to set up an outdoor fenced area to provide beverage service for the event. Buffalo Wild Wings is going to be present to provide food in the area. Chief Zeigler said he saw no problems with his department and there would be auxiliary police assisting the MPD. Jack Toal from the 1st Street Armoury said that the crowd is estimated to be around 900-1,000. He also said that Bryan Robbins, one of the organizers, would have a group cleaning up the area right after the event. Andy Waters, Bijou Pub manager, said that he will have bouncers controlling the East exit from the outdoor area and that there will be no rain date. It was moved by Alderman Heatherly and seconded by Alderman Godina to approve the request by the Bijou Pub to hold an Outdoor Special Event on May 15, 2010 from 2:00 p.m. to 11:00 p.m. AYE: Aldermen Dollinger, Wells, Dan Heatherly, Godina, Tim Heatherly, Rutledge, Bates, and Alderwoman McNamara NAY: none MOTION CARRIED.
V. BIDS, PETITIONS AND COMMUNICATIONS
A. Approval of 2010 MFT Bid
Administrator Hanson reported that the MFT bids were opened on April 30, 2010 and the low bid was submitted by Gunther Construction in the amount of $529,432.00, which was around $100,000 below the engineer's estimate of $636,982.00. The City has the capacity to do $700,000 worth of work; therefore, we will be working to identify additional streets to be included. It was moved by Alderman Bates and seconded by Alderman Tim Heatherly to accept the 2010 MFT low bid of $529,432.00 from Gunther Construction. AYE: Aldermen Wells, Dan Heatherly, Godina, Tim Heatherly, Rutledge, Bates, Dollinger, and Alderwoman McNamara NAY: none MOTION CARRIED.
VI. OTHER BUSINESS
A. City Administrator's Report
Administrator Hanson and EMC Public Works Director Andy Jackson said that we had not heard back from Illinois Power about the backup for the stop lights.
VII. ADJOURNMENT
It was moved by Alderman Dan Heatherly and seconded by Alderman Rutledge to adjourn the meeting at 7:25 p.m. MOTION CARRIED by unanimous voice vote.
