CITY OF MONMOUTH

COUNCIL MEETING MINUTES

 

Date:   May 17, 2010                         Time:  7:00 p.m.                            Location:        100 East Broadway

I. CALL TO ORDER & PLEDGE OF ALLEGIANCE

Mayor Rod Davies called the meeting to order in the Council Chambers at City Hall at 7:00 p.m. and led the audience in the Pledge of Allegiance to the Flag.

II. ROLL CALL

City Clerk Susan Trevor called the roll and those answering Present were:  Aldermen Tim Heatherly, Dave Rutledge, Dave Bates, Les Dollinger, Bob Wells, Dan Heatherly, Jaime Godina and Alderwoman Vicki McNamara   Also Present:  Mayor Rod Davies, City Clerk Susan S. Trevor, City Administrator Eric Hanson, City Attorney Marcum Spears, Fire Chief Jim Conard, Police Chief Brad Zeigler, EMC Public Works Director Andy Jackson, Cemetery/Zoning Administrator Chuck Talley, and members of the Press.

III. APPROVAL OF MINUTES

A.  May 3, 2010 Council Minutes and the May 3, 2010 Public Hearing Minutes

It was moved by Alderman Bates and seconded by Alderman Dollinger to approve the minutes of the May 3rd meeting of the Council and the Public Hearing collectively as presented.   AYE:  Aldermen Tim Heatherly, Rutledge, Bates, Dollinger, Wells, Dan Heatherly, Godina and Alderwoman McNamara    NAY:  none   MOTION CARRIED.

IV.      PRESENTATION TO THE COUNCIL

A.  Old Business

There was none to consider.

B.  New Business

1.   Consent Agenda

a.  Approval of Bills

b.  Mayoral Appointments:

1)  Affirmative Action Officer – Kathy Johnson

2)  FOIA and Public Information officer – Susan Trevor

c.  Approval of Alternative #3 for the LTCP and Authorization for Submittal of the LTCP Report to the IEPA by Donohue & Associates

d.  Approval of Ordinance 10-014, Prevailing Wage for 2010

It was moved by Alderman Tim Heatherly and seconded by Alderman Godina to approve the Consent Agenda as presented.   AYE:  Aldermen Bates, Dollinger, Wells, Dan Heatherly, Godina, Tim Heatherly, Rutledge and Alderwoman McNamara    NAY:  none   MOTION CARRIED.  

C.  Committee of the Whole discussion Items

1.  MFD Monthly Report – Chief Conard

Chief Conard reviewed the monthly report with the Council.  He reported that there were 109 Total Incidents for the month of April, which brings the YTD incident total to 344.  For the April MFD Activity Report, Chief Conard listed 24 hours of review of building and sprinkler plans plus on-site inspections within the City for himself.  MFD members performed building and grounds maintenance at both stations for a total of 140 hours; performed vehicle and equipment maintenance at both stations for a total of 125 hours; performed public education service for a total of `10 hours and fulfilled in-house training hours required by the State of Illinois for a total of 450 hours; and MFD investigators spent 1 hour of investigation.

2.  MPD Monthly Report – Chief Zeigler

Chief Zeigler reviewed the monthly report with the Council.  He broke down the April MPD activity as follows:

a. There were 92 arrests, which brings the YTD total to 465.

 

b. There were 1421 calls for service, which brings the total to 5,239 for the year.

c. Communications dispatched 2,376 calls for service in April, which brings the total to 9,026 calls YTD.

d. The officers worked 19 accidents in April.

e. Grant hours totaled 24 hours for Lincoln Homes and traffic details.

f. 13,689 miles were patrolled by the MPD for the month of April.

3.  Zoning Monthly Report – Chuck Talley

Chuck called attention to the report that was posted on-line for the May 3rd meeting and said that the Downing Construction Office Building, Monmouth Crossing and Pizza Hut projects were progressing nicely.

4.  WWTP Update – Joe Pisula

Mr. Pisula reported that the WWTP contractor, Williams Brothers, has begun work on a punch list, but has been held up on the outside work due to the weather.  There are still some control problems with the excessive rain, but these problems are being addressed.  The City is still meeting permit regulations except for the phosphorous limit.

5.  Outdoor Special Event Bean Bag Tournament Request – Tooties

Mike Strom, owner of Tooties, requested permission from the Council to host an outdoor Bean Bag Tournament as a fundraiser for W.I.R.E. on May 22nd from Noon to 9:00 p.m.

Mr. Strom submitted the required drawing showing the fencing of the outdoor area.  The required liability certificate is on file according to the City Clerk.  It was moved by Alderman Tim Heatherly and seconded by Alderman Rutledge to approve the above-stated request.   AYE:  Aldermen Dollinger, Wells, Dan Heatherly, Godina, Tim Heatherly, Rutledge, Bates, and Alderwoman McNamara   NAY:  none    MOTION CARRIED.

V.    ORDINANCES & RESOLUTIONS

A.  1st Reading

1.  10-015 – Annexing Certain Territory

It was moved by Alderman Bates and seconded by Alderman Rutledge to approve the annexation of property North of Bypass 34 in the Enterprise Zone to the corporate limits of the City of Monmouth as referenced in Ordinance 10-015.   AYE:

Aldermen Dollinger, Wells, Dan Heatherly, Godina, Tim Heatherly, Rutledge, Bates, and Alderwoman McNamara   NAY:  none   MOTION CARRIED.

2.  10-016 – Expansion of the Enterprise Zone

It was moved by Alderman Godina and seconded by Alderman Dollinger to approve Ordinance 10-016 expanding the boundaries of the Enterprise Zone until the expiration of the Zone on December 31, 2015.   AYE:  Aldermen Wells, Dan Heatherly, Godina, Tim Heatherly, Rutledge, Bates, Dollinger, and Alderwoman McNamara   NAY:  none   MOTION CARRIED.

 

3.  10-017 – Granting Variance, 119 South 10th Street

It was moved by Alderman Dollinger and seconded by Alderman Godina to approve Ordinance 10-017, Granting Variance for 119 South 10th Street to construct a 24' X 36' garage.   AYE:  Alderwoman McNamara, Aldermen Dan Heatherly, Godina, Tim Heatherly, Rutledge, Bates, Dollinger, and Wells   NAY:  none   MOTION CARRIED.

4.  10-018 – Granting Variance, 701 South Main Street

It was moved by Alderman Wells and seconded by Alderman Rutledge to approve Ordinance 10-018, Granting Variance for 701 South Main Street to construct an addition onto a non-conforming structure.   AYE:   Aldermen Godina, Tim Heatherly, Rutledge, Bates, Dollinger, Wells, Dan Heatherly, and Alderwoman McNamara   NAY:  none   MOTION CARRIED.

5.  10-019 – Granting Variance, 714 North D Street

It was moved by Alderwoman McNamara and seconded by Alderman Godina to approve Ordinance 10-019, Granting Variance for 714 North D Street to replace an existing porch.   AYE:  Aldermen Godina, Tim Heatherly, Rutledge, Bates, Dollinger, Wells, Dan Heatherly, and Alderwoman McNamara   NAY:  none   MOTION CARRIED.

6.  10-020 – Granting Home Occupation and Use Variance, 215 North 1st Street

It was moved by Alderman Godina and seconded by Alderman Rutledge to approve Ordinance 10-020, Granting a Home Occupation and Use Variance at 215 North 1st Street for small engine repair inside the entire garage.  AYE:  Aldermen Tim Heatherly, Rutledge, Bates, Dollinger, Wells, Dan Heatherly, Godina, and Alderwoman McNamara   NAY:  none   MOTION CARRIED.

VI. EXECUTIVE SESSION

It was moved by Alderman Dollinger and seconded by Alderman Tim Heatherly to go into Executive Session at 7:22 p.m. to consider the possible purchase of real estate.   AYE:  Aldermen Rutledge, Bates, Dollinger, Wells, Dan Heatherly, Godina, Tim Heatherly, and Alderwoman McNamara   NAY:  none   MOTION CARRIED.

VII.   RETURN TO REGULAR SESSION

It was moved by Alderman Bates and seconded by Alderman Tim Heatherly to return to Regular Session at 7:39 p.m.   AYE:  Aldermen Dollinger, Wells, Dan Heatherly, Godina, Tim Heatherly, Rutledge, Bates, and Alderwoman McNamara   NAY:  none   MOTION CARRIED.

It was then moved by Alderman Wells and seconded by Alderman Godina to authorize the Mayor and the Clerk to enter into a purchase agreement for property located at 1125 North Main Street.   AYE:  Aldermen Bates, Dollinger, Wells, Dan Heatherly, Godina, Tim Heatherly, Rutledge, and Alderwoman McNamara   NAY:  none   MOTION CARRIED.

VIII.   OTHER BUSINESS

A.  City Administrator's Report

Administrator Hanson had nothing to report at this time.

IX.   ADJOURNMENT

It was moved by Alderman Rutledge and seconded by Alderman Tim Heatherly to adjourn the meeting at 7:40 p.m.   MOTION CARRIED by unanimous voice vote.
