COUNCIL MEETING MINUTES

I.       CALL TO ORDER & PLEDGE OF ALLEGIANCE

Mayor Rod Davies called the meeting to order in the Council Chambers at City Hall, 100 East Broadway at 7:00 p.m. and led the audience in the Pledge of Allegiance to the Flag.

II.      ROLL CALL

City Clerk Susan S. Trevor called the roll and those answering   Present were: Aldermen   Tim Heatherly, Dave Rutledge, Dave Bates, Brian Daw, Bob Wells, Dan Heatherly and Jaime Godina      Absent: Alderwoman Vicki McNamara   Also Present: Mayor Rod Davies, City Administrator Eric Hanson, City Clerk Susan S. Trevor, City Attorney Marcum Spears, MFD Chief John Cratty, MPD Chief Brad Zeigler, EMC Public Works Director Andy Jackson, Building Inspector Jim Conard, Community Development Director Paul Schuytema and members of the Press.

III.     APPROVAL OF MINUTES – October 17, 2011

A.  October 17, 2011 Council Minutes

It was moved by Alderwoman Bob Wells and seconded by Alderman Godina to approve the minutes of the October 17, 2011 Council Meeting as presented.    AYE: Aldermen Tim Heatherly, Rutledge, Daw, Wells, Dan Heatherly, and Godina   PASS: Alderman Bates   ABSENT: Alderwoman McNamara    NAY: none   MOTION CARRIED.

IV.     PRESENTATION TO THE COUNCIL

A.   Old Business

There was none to consider.

B.   New Business

1.   Maple City Street Machine Presentation

Mayor Rod Davies presented a plaque on behalf of the City to Jamie Smith and Bob Thompson of the Maple City Street Machines recognizing them for their efforts in making the annual Maple City Cruise such a tremendous success.  In turn, Jamie Smith and Bob Thompson presented a plaque to Mayor Davies thanking the City of all their support in making the Maple City Cruise night successful.

2.   Consent Agenda

a.   Approval of Bills

b.   Request for Signage for Maple City Tumblers Champion

c.    Resolution for Installation of Street Lights at Corner of Boston and                                             North Main; Harlem and North Main

It was moved by Alderman Godina and seconded by Alderman Dan Heatherly to approve the Consent Agenda as presented.   AYE: Aldermen Rutledge, Bates, Daw, Wells, Dan Heatherly, Godina, and Tim Heatherly   ABSENT: Alderwoman McNamara   NAY: none   MOTION CARRIED.

C.   Committee of the Whole Discussion Items

1.  Zoning October Report – Building Inspector Jim Conard

Mr. Conard reviewed the October Zoning Report as follows:

Ø 43 Permits issued for a total value of $211,600 and fees of $1,920.

Ø 339 YTD Permits issued for a total value of $33,824,195 and fees of $84,360.00.

Ø YTD Permit Report comparison with 2010 is 339 for 2011 to 338 in 2010.

Ø 25 Junk and Debris notices were sent with 13 cleaned; 3 fined and 9 to be checked

Ø 13 Mowing Notices were sent with City mowing 9 and Owners moving 3.

2.   EMC September Report – EMC Public Works Director Andy Jackson

Mr. Jackson reported that September was a fairly typical maintenance month and he gave the following updates:

ü Well # 4 has been repaired and put back into service last week.

ü Leaf pick-up is in full swing

ü Snow plows and trucks are being serviced in preparation for the Winter season

ü A meeting was held today, November 7th for the final “punch list” on the Phosphorus Project.

V.     ORDINANCES

A.  2nd Reading

1. 11-021 – Amending Chapter 99, Section 99.036 Entitled “Fences”

2. 11-022 – Amending Section 150.002 Entitled “Adoption of City Building Code by reference: Amendments

3. 11-023 – Adding Chapter 124 Entitled Rental Registration and Inspections

Prior to calling for a motion to approve Ordinances 11-021, 11-022 and 11-023, Mayor Davies invited any citizen who would like to address the Council regarding these proposed ordinances to please come to the podium, state their name and address and their concerns pertaining to these above-stated ordinances.  Mr. Bill Leonard, Box 42, Biggsville addressed the Council as to the Rental Registration Ordinance.  He stated that he owned a 10 unit apartment building in the 300 block of North 1st Street.   In 2009 the City passed an ordinance banning parking in the 300 block of North 1st and now in the new proposed ordinance it will require a certain number of parking spaces per unit.  Mr. Leonard is concerned as to how he can comply with the proposed ordinance and whether the new ordinance would make provisions for his dilemma.  City Attorney Spears stated that since Mr. Leonard owned his apartment building when the original Zoning ordinance, which did not require any set number of parking spaces per unit, was passed in 1982, his apartment unit would be “grandfathered in”; therefore, he would not have to provide a set number of parking spaces per unit.  It was then moved by Alderman Dan Heatherly and seconded by Alderman Wells to collectively approve Ordinances 11-021, 11-022, and 11-023 on their 2nd Reading.   AYE: Aldermen Bates, Daw, Wells, Dan Heatherly, Godina, Tim Heatherly, and Rutledge   NAY: none   ABSENT: Alderwoman McNamara   MOTION CARRIED.

B.  1st Reading

1.  11-025 – Amending Chapter 154 to Zoning Code Non-Conforming Properties

City Attorney Spears explained that Ordinance 11-025 is addressing the non-conforming properties that were not addressed with the passage of the 1982 Zoning Ordinance.  It was moved by Alderman Tim Heatherly and seconded by Alderman Dan Heatherly to approve Ordinance 11-025.  AYE: Aldermen Daw, Wells, Dan Heatherly, Godina, Tim Heatherly, Rutledge and Bates   NAY: none   ABSENT: Alderwoman McNamara   MOTION CARRIED.

VI.    OTHER BUSINESS

A.  City Administrator’s Report

Administrator Hanson had nothing further to report at this time.

B.   Citizen Inquiries

There were no further inquiries at this time.

VII.    ADJOURNMENT

It was moved by Alderman Dan Heatherly and seconded by Alderman Tim Heatherly to adjourn the meeting at 7:30 p.m.   MOTION CARRIED by unanimous voice vote with the exception of Alderwoman McNamara, who was absent.
