Freedom of Information Forms Freedom of Information Compliance Introduction FREEDOM OF INFORMATION ACT COMPLIANCE INTRODUCTION:
There were some significant changes in the Freedom of Information Act of 1982 that became effective January 1, 2010. Some of the more significant changes are:
1) The response time for a Public Body to respond to a request has been decreased from seven to five business days.
2) Definition of "public record" to include electronic communications; new definition of "private information" and new definition of "commercial purpose"
3) Addition of four new sections concerning the disclosure of certain types of documents:
Section 2.5, records relating to public funds are public records subject to copying and inspection
Section 2.10, certified payroll records, Prevailing Wage Act
Section 2.15, disclosure of arrest reports within 72 hours and governs the treatment of criminal history records
Section 2.20, settlement agreements are public records that are subject to disclosure
4) Commercial Requests must be responded to in one of four ways within 21 working days after receiving a commercial request
5) The creation of a Public Access Counselor, who must be a licensed attorney appointed by the Attorney General and who will review all denials and issue a binding opinion within 60 days after the request for review. That binding opinion is subject to administrative review by either party.

3. Requests will be processed within 5 days unless an extension of five (5) additional days is justified under Sec. 3(e) of the Act.
